Terms & Conditions

The Axiata Game Hero (“Axiata Game Hero”) is a mobile game portal that offers all genre of mobile game, web game and tournament game available on smartphones. The Axiata Game Hero Tournament is a regional eSports tournament (hereinafter referred to as the “Tournament”) in collaboration with Axiata Group Berhad, Celcom Axiata, Boost, Dialog Axiata, Robi Axiata and Smart Axiata,  (“Mobile Operators”). The Tournament is organized by Axiata Game Hero (the “Organiser”). By participating in the Tournament, the participants (“Participants”) hereby agree to be bound by these terms and conditions which shall form an integral part of, and to be read together with, the terms and conditions of the Participants’ registration form (“CRF”) and/or terms and conditions of the respective mobile/content service(s) offered and relevant to the Participants in respect of the Tournament.

In the event of a conflict or inconsistency between these terms and conditions and CRF and/or terms and conditions of the respective mobile/content service(s), such inconsistency shall be resolved by giving precedence in the following decreasing order:

     (a)    these terms and conditions;

     (b)    tournament rules for National 1, National 2 and Grand Championship

     (c)     terms and conditions of CRF; and

     (d)    terms and conditions of the respective mobile/content service(s).

1. General

1.1 The Organiser reserves the sole and absolute right to withdraw, amend, omit and/or vary any part or the whole of these terms and conditions of this Tournament with a prior notice to the Participants herein stated and the Participants shall be bound to observe, perform and comply with the terms and conditions herein and any amendments thereof so notified to the Participants.

1.2 The Organiser’s decisions on any matter relating to the Tournament are final and binding on all Participants. If any matters were to arise which are not covered in these terms and conditions, such these matters will be determined solely by the Organizer.

1.3 The Organiser may change any of these terms and conditions including terminating or suspending the Tournament and extending the Tournament Period (as hereinafter defined). Any such change will be announced in the website. It is your responsibility to check these terms and conditions on the website and if you do not agree to any of the changes, you must immediately cease participation in the Tournament.

1.4 Except as expressly mentioned herein, the Organiser shall not be responsible for any expenses and costs incurred by a Participant, including out-of-pocket expenses related to or as a consequence of participating in the Tournament.

 

2. Fair Play

2.1 All Participants are expected to play at their best at all times without getting involved in the following offences:

Collusion Cooperation with competing participants to cheat or deceive in order to gain an unfair advantage. Acts of collusion include, but are not limited to:
  • Soft play (Any agreement among participants to not play at a reasonable or expected standard of competition in a game)
  • Prior arrangements to split tournament prizes
  • Receiving information and signals from external sources during a match
  • Losing Deliberately
Hacking Any modification of the game client, and the use of any 3rd party apps within the game is strictly prohibited
Exploiting Deliberate abuse of bugs to gain an advantage
Smurfing Using another player or participant’s account
PC/emulator Strictly not allowed, if player are found using pc emulators the squad will be disqualified
Android No Root Implementing & executing PUBG hacking script

 

2.2 The Organiser shall have the right, at its own discretion to disqualify, exclude or eliminate any Participant from participation in the Tournament, to refuse from awarding the prize and to demand the return of any previously awarded prizes in the Tournament in the event the Participant has committed any offences as specified in Clause 2.1 above.

2.3 The Organiser, at their sole discretion, will determine the need for a remake or rematch, if the any offences as specified in Clause 2.1 above was found to occur. Any objection will not be entertained.

3. Tournament Details

The Organiser reserves the right to change the information below at any time without prior notice and any objection will not be entertained.

3.1 Participants Eligibility

3.1.1 The Participant must be at least sixteen (16) years of age to join the Tournament,  and parents’ consent letter is required for Participant for below eighteen (18) years.

3.1.2 The Tournament is open to all citizen of Malaysia and are currently residing in Malaysia.

3.1.3 The Participant must have a valid PlayerUnknown’s Battlegrounds ID and game’s application (“PUBG”).

3.1.4 The Participant must be the sole owner of the SIM card subscription and the mobile number (MSISDN) used in the Tournament. The Participant is not allowed to appoint any other individual to represent him or her in the Tournament.

3.1.5 For clarity, the following personnel shall not be eligible to participate in any Tournament:

             (a)       the Organiser’s employees (including employees of its related corporation), their advertising agency and their immediate family members; and

             (b)      For clarity, immediate family members shall be:

i.         for unmarried/single employees – their parents and sibling(s) and spouse(s) of the sibling(s); and

ii.       for married employees – their spouse(s), parents and children (including adopted children).

3.1.6 Disqualification

  1.  The Organiser reserves the right to reject any entries at its discretion subject to Clause 2 and Clause 3.1.6 of these terms and conditions
  2.  Any Participant has committed any offences as specified in Clause 2.1 above.
  3.  The Participant need to be an active subscribers of Axiata Gamehero for at least 1 week before able to join Solo Online Tournament or 2 weeks before able to join Squad Online Tournament as per Clause 5.4
  4.  In the event successfully registered Participants unsubscribe to Axiata Game Hero as specified in Clause 4.1.5, a Participant’s PUBG player account is suspended or left their Squad, the said Participant will be disqualified until the situation is rectified. Once situation has been rectified, the said Participant can participate the tournament but their score on the leaderboard will reset

3.1.6 Entry, Renewal, Deduction and Redemption Point/s

  1.  The Participant will have the chance to get ten (10) Points as specified in Table 1 upon receiving success subscription via message (“Entry”);
  2.  Consecutively, the Organiser will charge user based on the fee and period specified with Table 2 and upon success deduction of Participant’s phone billing (“Renewal”), the Participant will have the chance to get ten (10) points as specified in Table 1
  3.  The Participant can redeem their scores based on items stipulated in Table 1
  4.  Deduction of fifty (50) points if the Participants missed or skip tournament after registered in Tournament Schedule
  5.  Entry and Renewal points can be redeemed as per items specified in Table 1
  6.  The Participants can redeem game score with maximum three (3) times during Tournament Period
  7.  The Organiser has the right to change the Redemption Item as stipulated in Table 1
  8.  The Organiser has the right to restrict the withdrawal of all or a portion of items for defined period of time for risk management purposes.
  9.  The points for Entry, Renewal, Deduction and Redemption will be as follows:

3.1.7 Prizes Breakdown

  3.  The prize is non-transferable. The prize is given on an “as is where is” basis. The Organizer reserves the right to substitute and replace the prize offered with another prize of equal value or higher value as the Organizer deems fit without prior notice.
  4.  The prize winners must collect the prizes during a specified period and at the venue specified by the Organiser and may be required to attend a prize-giving ceremony. If the winners fail to collect the prize during the prize collection period of two (2) weeks or, if called upon to attend a prize-giving ceremony but failed to attend at such a prize-giving ceremony, the Organiser shall have the right to select another Squad as the winner
  5.  The winners are required to bring along their respective original identification cards or passports for verification purpose during collection of the prize. The prize winners are required to furnish their bank account details for distribution of the prizes. The Organiser shall not be held liable for non-receipt or delay in distribution of the prizes in the event of invalid, inaccurate or incomplete bank account details provided by the winners or their representatives. Prior notification to the Organiser is required to be given by the winners in the event the winners are sending a representative to collect the said prize.
  6.  The winners will each win one (1) unit of the prizes ("Prizes") depending on their scores during the Tournament stages.
  7.  The prize stated in USD. In case of conversion is required, the exchange rate will be based on the rate of the financial institute at the time and day of transfer.
  8.  For foreign transaction (aside from Malaysia), the processing and delivery of the prizes will take estimate of around 90 days.

4. Tournament Mechanism

4.1 Registration to Axiata Gamehero

4.1.1 The Participant’s registration to Axiata Game Hero will be subjected to a fee as stipulated by payment channels as per Table 3

4.1.2 Upon successful Registration, the Participant shall receive an SMS confirmation of the Participants’ registration. A registered Participant must at all times comply with these terms and conditions.

4.1.3 The Registration Fee is non-refundable and must be paid upon registration.

4.1.4 A Participant may terminate its subscription to Axiata Game Hero via SMS or clicking the unsubscribe button in the profile page of www.gamehero.asia website or contact the Organiser to cancel his or her subscription to Axiata Game Hero

4.1.5 To participate in the Online Tournament, the Participants are required to register with Axiata Game Hero and linked their PUBG ID and also register their interest in Online Tournament schedule as specified in Clause 5.4

4.1.5 A Participant may terminate its subscription to Axiata Game Hero via SMS or clicking the unsubscribe button in the profile page of www.gamehero.asia website or contact the Organiser to cancel their subscription to Axiata Game Hero.

4.1.6 The participant will join as Solo and create or join squad which herein defined as below

  1.  The Participant who play as one (1) player is a Solo Player (“Solo”) and against other Solo players in Solo mode; and
  2.  The Participant who play in team of four (4) players is Squad Player (“Squad”) and against other Squad player in Squad mode. The four (4) players consist of the Participant who are active subscribers to Axiata Game hero as per specified in Clause 4.2.

4.2 Squad Player

4.2.1 A squad will assign a team leader

4.2.2 A Squad may not change its squad name throughout the Tournament Period as specified in Clause 5, and any change to the squad name can lead to the disqualification of the squad from the Tournament

4.2.3 Each Participant can be a member of only one (1) Squad throughout the Tournament Period as specified in Clause 5

4.2.4 A squad need to assign a squad name (“Squad Name”) and Squad Name cannot be change throughout Tournament Period specified in Clause 5

5. Tournament Stages

There 3 main stages throughout a period of nine (9) months which shall commence from 23 March 2021 to December 2021 (“Tournament Period”).

All entries received outside this time frame shall be automatically disqualified.

5.1 National 1

  1.  All Participants who join from March 2021 to July 2021 will be consider in the first (1) round of qualifier (“National 1”).
  2.  All Participants need to participate in either Solo or Squad Tournament in order to eligible to Grand Final. Participants need to register themselves in Tournament Schedule specified in Clause 5.4.
  3.  Top 50 participant score during Solo or Squad Online Tournament will be shown in Solo or Squad Leaderboard.
  4.  Top 16 Solo player in Solo Leaderboard and top 12 Squads in Squads Leaderboard will compete in Squad Mode in final.

5.2 National 2

  1.  All Participants who join from August 2021 to November 2021 will be consider in the first (1) round of qualifier (“National 2”).
  2.  All Participants need to participate in either Solo or Squad Tournament in order to eligible to Grand Final. Participants need to register themselves in tournament schedule specified in Clause 5.4.
  3.  Top 50 participant score during Solo or Squad Online Tournament will be shown in Solo or Squad Leaderboard.
  4.  From each Solo qualifier round, top 4 Solo players will be selected to form a Squad & proceed to compete in the National Final 2.
  5.  From each Squad qualifier round, top 3 squads will be selected & proceed to compete in the National Final 2.
  6.  There will be a total of 16 Solo player and 12 Squads to compete in the National Final 2.

5.3 Grand Final

  1.  Grand Championship is tournament with top 2 Squads from final National 1 and National 2 from participating Mobile Operators (“Grand Championship”).
  2.  The details of Grand Championship will be announced by the Organiser separately and the Organiser has right to modified the details in order to comply with Mobile Operator’s country rules and regulation.
  3.  The Participant agreed to bear their own expenses for travel documentation, transportation and daily expenses when attending the Grand Championship.
  4.  The Organiser will announce the Grand Championship details and any objection from the Participant will not be entertained.

5.4 Tournament Schedule

  1.  The Participant need to register to Solo or Squad online tournament (“Online Tournament”)
  2.  The Participant can do so by login to www.gamehero.asia and select “Tournament Schedule”.
  3.  Some Online Tournament are held over a period of days and weeks, this information will be provided after the Organiser have the Participant’s grouping ready
  4.  In event of Participant’s schedule clash with Online Tournament date, The Participant’s need to select the next available Online Tournament and understand the Organiser cannot change Online Tournament’s details.
  5.  Participants need to understand the Online Tournament details and grouping timing. Participant understand that if fail to understand the Online Tournament details will be resulted in denied entry to Online Tournament.
  6.  If there are significant internet issues that affect multiple players and/or teams, the Organisers has right to cancel a tournament and inform the Participant and communicated as soon as possible..
  7.  In event of Participant’s schedule clash with Online Tournament date, The Participant’s need to select the next available Online Tournament and understand the Organiser cannot change Online Tournament’s details.

5.5 Leaderboard

  1.  Leaderboard is where the Participant’s identification, scores and positions in the Tournament will be featured on www.gamehero.asia (“Leaderboard”)
  2.  Top fifty (50) scores in Online Tournament will be shown Solo or Squad Leaderboard
  3.  Solo Leaderboard will show scores of Solo Participants in Solo Online Tournament as per illustrated in Clause 5.5 (“Solo Leaderboard”)
  4.  Squad Leaderboard will show scores of Squad Participant in Squad Online Tournament as per illustrated in Clause 5.5 (“Squad Leaderboard”)
  5.  The Participants understand that Participant need to join Online Tournament as per Clause 5.4 in order to have Participants score recorded in Solo or Squad Tournament as per in Clause 5.5

5.6 Score Calculation

  3.  Participants can play unlimited numbers in Solo or Squad Online Tournament. However, only top 3 scores will be counted and reflected on the Solo or Squad Leaderboard as per illustrated below in Table: 5-

    The best top 3 scores from Table 5 will be added, and this score will be reflected on the leaderboard. Hence, 300+500+600=1400

6. Privacy Policy

Upon the completion of registration for the Tournament, Participants consent to allow the Organiser to:

6.1 Collect, record, hold, store, use and disclose their personal information for purposes which are necessary or related to participation in the Tournament.

6.2 Disclose or publish their personal information such as their names and identities and any general information relating to the Participants that the Organiser sees fit in any media, marketing or advertising materials

6.3 Grant the Organiser the absolute and unrestricted right to modify, use and publish any still or moving images of the Participants for any promotional, marketing, commercial or other related purpose, without any payment or compensation.

7. Exclusion of Liability

7.1 To the extent permitted by law, the Organiser excludes all liability in connection with the Tournament. All Participants agree to release the Organiser from and indemnify the Organiser against all liability (including negligence) for any personal injury or for any loss or damage (including loss of opportunity), whether direct or indirect, special or consequential arising out of participation in the Tournament.

7.2 The content provided on the website and any other information provided in relation to the game and Tournament is strictly on an “as is where is” basis. The Organiser does not guarantee nor warrant true and flawless representation of the game and the Tournament.

7.3 The Organiser disclaims any and all the responsibility and liability from any loss and disruption caused by the malfunction of the mobile phone, viruses or contamination which is beyond the control of the Organizer.

7.4 Once the game has commenced, any Participants inability to play due to faulty hardware or any malfunction on the mobile phone or any other technical failures which is beyond the control of the Organizer shall not entitle the Participants to any refund of the Registration Fee.

8. Intellectual Property Rights

8.1 The information contained herein, on the websites and at the Tournament which include but not limited to texts, graphics, photos, sounds, video, software, interactive feature and trademark, service marks and logos shall be solely owned by the Organiser and the Participants undertake not to misuse any of the information contained herein, on the websites and at the Tournament

8.2 The Organiser reserves the right to terminate and revoke the Participants’ registration and participation in the Tournament if the Participants breach the provision in relation to intellectual property rights contained herein.

9. Governing Law & Jurisdiction

The Tournament(s) and these terms and conditions are governed by the laws of Malaysia. The Participants agree that the Courts of Malaysia shall have non-exclusive jurisdiction over all matters arising from the Tournament and these terms and conditions.

10. Force Majeure

Neither party shall be responsible for its failure to perform due to causes beyond its reasonable control such as acts of God, fire, theft, war, riot, embargoes or acts of civil or military authorities.

11. No Waiver

Failure by either party to enforce any provision of these terms and conditions will not be deemed a waiver of future enforcement of that or any other provision.

12. Severability

If for any reason a court of competent jurisdiction finds any provision of these terms and conditions, or portion thereof, to be unenforceable, that provision of the terms and conditions will be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of these terms and conditions will continue in full force and effect.
